Platform: FisheryPass.com (“FisheryPass”, “Platform”, “we”, “us”)
1. Acceptance of Terms
By creating an account, booking a peg/swim, or listing a fishery on FisheryPass.com, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.
2. Nature of the Platform
FisheryPass provides a software-as-a-service (SaaS) booking engine that connects anglers (“Users”) with independent fishery owners (“Operators”). FisheryPass does not own, manage, or operate any listed lakes or waterways.
3. Angler Rules & Bookings
- Peg Allocation: Bookings guarantee access only to the specific swim, peg, or sector selected during checkout for the designated time slot.
- On-Site Conduct: Users must strictly adhere to the specific rules posted by the individual Fishery Operator (e.g., net dipping, unhooking mat standards, rod limits, guest policies). Fishery Operators reserve the right to evict any User without refund for rule violations.
- Vehicle & Access: Users must provide accurate vehicle registration numbers if required for on-site gate access or bailiff verification.
4. Payments, Cancellations & Refunds
- Payments: All fees are processed securely at the time of booking via authorised payment gateways (e.g., Stripe).
- Cancellations: Cancellation policies, including deposit returns or date transfers, are set by the individual Fishery Operator and displayed on the listing page prior to payment. FisheryPass service fees are non-refundable unless a cancellation is caused by system error.
5. Platform Usage & Prohibited Behavior
Users and Operators agree not to:
- Use automated scripts or bots to reserve pegs (“peg scraping”).
- Attempt to bypass FisheryPass payment systems to book listed swims off-platform.
- Post false, misleading, or defamatory reviews regarding fisheries or facilities.
6. Limitation of Liability
FisheryPass is not responsible for personal injury, property loss, poor fishing performance, adverse weather conditions, or dispute resolutions arising on-site at a listed fishery. The platform’s total liability is limited to the transaction fee collected for the booking in question.
